General Terms and Conditions of Use (GTCU) for the COCOFAN loyalty program at COCOBLANC.
Article 1 - PURPOSE OF THE LOYALTY PROGRAM
The COCOFAN Loyalty Program, hereinafter referred to as the "COCOFAN Loyalty Program", is a program developed by SF CREATIONS, a company with capital of 100,000 Pacific francs, whose registered office is located in Moorea, PK6.8, Paopao, currently registered with the RCS in Papeete - Tahiti number: F33296.
The aim of the COCOFAN loyalty program is to establish a special relationship between the COCOBLANC boutique and customers who have joined the program (hereinafter referred to as "members") and to enable them to benefit from special offers.
Membership of the COCOFAN loyalty program implies full acceptance by the member of these General Terms and Conditions of Use (GTCU).
Article 2 - CONDITIONS OF MEMBERSHIP IN THE COCOFAN LOYALTY PROGRAM
The COCOFAN loyalty program is offered free of charge to any individual customer of legal age. It is not open to legal entities or groups, and is reserved for non-professional use.
The COCOFAN loyalty program is in force only in the COCOBLANC boutique, located in French Polynesia on the island of Moorea.
The member guarantees the accuracy of all information provided by the member and undertakes to use the program in accordance with these conditions. In the event of non-compliance, COCOBLANC reserves the right to exclude the member from the loyalty program.
Article 3 - HOW TO JOIN THE COCOFAN LOYALTY PROGRAM
The member wishing to join the COCOFAN loyalty program acknowledges having read and accepted without reservation the present General Conditions of Use of the "COCOFAN loyalty program". This document can be consulted on the website www.cocoblancmoorea.com / section: "COCOFAN General Terms and Conditions of Use (GTCU)".
COCOBLANC reserves the right to modify these General Conditions of Use of its loyalty program at any time.
To become a member and enable COCOBLANC to keep the customer informed of their points balance at any time and to offer them the advantages offered, the customer is asked to provide all the information required for registration, i.e. at least their first and last name and an e-mail address.
COCOFAN program benefits and enrolment details can be obtained directly from the COCOBLANC boutique.
Article 4 - PERSONAL DATA
As part of membership of the COCOFAN loyalty program, COCOBLANC collects personal data concerning the member. This information is processed electronically to enable COCOBLANC to process the member's requests in order to enable him/her to benefit from the loyalty program and also to send him/her commercial offers.
This information is recorded in a software file used by COCOBLANC and may, in accordance with the amended French Data Protection Act of January 6, 1978, give rise to the exercise of the right of access, rectification and deletion by contacting the managers of COCOBLANC, Stéphane or Franck Appleton - PK 6.8 côté montagne, Paopao in Moorea.
Article 5 - BENEFITS GRANTED TO MEMBERS OF THE COCOFAN LOYALTY PROGRAM
Joining the program enables the customer to become a member and therefore to collect a number of points based on the amount of their purchases in the boutique, and to benefit from a discount at the checkout regardless of the number of points reached. Purchases taken into account are those made over a twelve-month period in the COCOBLANC boutique.
From the very first purchase, members can earn 1 point for each Pacific franc (xpf) spent; each point gives rise to a discount of 0.10 xpf. With this rule of 1 point = 0.10 xpf, a purchase of 5,000 xpf, for example, earns the member 5,000 points and therefore a discount of 500 xpf on a future purchase and on all products in the store. Members can also keep their points to accumulate more before using them. Points are valid for 1 year from the last purchase made at COCOBLANC. If, however, the member does not take advantage of these points after one year, his or her points account will be reset to zero.
The member accumulates points from the time of joining. Purchases made prior to membership are not counted. Once a member has joined, purchases are counted without limit, and only those with a positive balance are taken into account.
The discount offered to the member is valid from the day after it is issued. The member is informed directly in the store and by e-mail if necessary. This discount is valid once in store, excluding the purchase of gift cards or payment for services (delivery, alterations). The offer cannot be combined with current promotions or sales. Nor can it be combined with any other offers available under the COCOFAN loyalty program. The Offer may not be reimbursed in cash or in any other way whatsoever. The discount is applicable immediately at the checkout.
Article 6 - CONSULTATION OF THE LOYALTY ACCOUNT
The member can check the purchases made on his loyalty account by going to the COCOBLANC boutique to make a request or by consulting the emails that COCOBLANC sends him to inform him of his points balance.
Article 7 - LIABILITY
7.1 MEMBER RESPONSIBILITY
The member is solely responsible for any use that may be made of the points allocated by COCOBLANC. In particular, the member undertakes to:
guarantee the accuracy of all the information provided when joining the COCOBLANC loyalty program,
ensure that the data communicated to COCOBLANC enabling contact to be made with the member (email, postal address, etc.) is secure and used solely by the member.
As such, the member may only benefit from one COCOFAN loyalty program opened in his/her name. Consequently, should COCOBLANC find that the same person holds several loyalty programs, COCOBLANC reserves the right to deactivate the member's registration.
7.2 RESPONSIBILITY OF COCOBLANC
COCOBLANC undertakes to do its utmost to guarantee the member of the COCOFAN loyalty program optimum use of the services linked to his/her membership.
COCOBLANC cannot, under any circumstances, be held responsible for any direct or indirect damage or for any malfunction of the COCOFAN loyalty program.
Article 8 - FIDÉLITÉ ACCOUNT MANAGEMENT / MODIFICATION OF PERSONAL DATA
Any change of postal or e-mail address or name must be notified by the member to COCOBLANC as soon as possible.
Article 9 - TRANSFORMATION OF THE PROGRAM TO SOLIDARY SALES
At COCOBLANC, we're fully aware that we're in a magnificent and wild environment, but one that's fragile and threatened. It seems necessary, even urgent, to respect the ocean and the land around us, and the women, men and animals who live there. In our day-to-day actions, we strive to make the best possible choices to help preserve nature, limit our carbon footprint, and fight discrimination and human exploitation. Environmental responsibility is therefore one of COCOBLANC's fundamental values, and even a duty.
COCOBLANC offers members of its COCOFAN loyalty program the possibility of donating the discount they receive thanks to the number of points they have earned in the COCOFAN loyalty program, to an association selected by COCOBLANC.
Article 10 - MODIFICATION OR TERMINATION OF THE LOYALTY PROGRAM
COCOBLANC reserves the right, at any time, to modify or terminate the COCOFAN loyalty program without having to justify its decision and without any compensation whatsoever to the member.
COCOBLANC also reserves the right to modify the points accumulation scales, any other advantage linked to the COCOFAN loyalty program as well as the related services without having to justify its decision and without any compensation for the member.
The present General Conditions of Use (GCU) may be modified at any time and without prior notice by COCOBLANC, which the member accepts without reservation. The member is therefore invited to regularly consult the latest updated version, which can be accessed at any time on the www.cocoblancmoorea.com website, under the heading "COCOFAN loyalty program", or by clicking on the General Terms of Use (GTU) link on the " COCOFAN loyalty program " page of the www.cocoblancmoorea.com website .
Article 11 - Applicable law, jurisdiction and language
All disputes, whatever their nature, will be submitted to the Commercial Court of Papeete, Tahiti, French Polynesia, to which jurisdiction is expressly granted, even in the event of multiple defendants or the introduction of third parties.
The present text in French has sole contractual value and is the only authentic text between the parties.
